Basic rules:
1) You must pay via invoice. This will be sent to you after your commission has been accepted and pricing has been finalized. If you do not have access to an available payment method, feel free to reach out to me to discuss alternate methods.
2) All commissions under 300$ USD must be paid in full up-front. If your commission exceeds this cost, we may discuss alternate payment plans. You will not receive the high-quality, unwatermarked commission until full payment is received.
3) You may not use the commission for commercial use. This includes using the commission to advertise the sale of other products. If you would like to receive a commercial license for the commission, you may contact me to negotiate the terms.
4) You may not use the commission to: spread hate, bigotry towards marginalized groups, or in conjunction with fascist, racist, or Nazi rhetoric, imagery, and ideals; or to train Artificial Intelligence models, nor may you use Artificial Intelligence to modify the commission in any way.
5) You must provide references, unless otherwise specified. Failure to provide references will change the price of the commission. If you'd like your character in specific clothing, please provide references for that as well.
6) Any prices provided in promotional materials are estimates. Prices may vary. The complexity of a commission may result in additional charges. Any price changes will be communicated to you prior to payment. Please reach out to discuss pricing at any time prior to the beginning of the commission. The base price of the commission is not flexible.Things I will draw:

I. I reserve the right to discontinue or refuse a commission at any time, for any reason. If your commission is incomplete, you will be given a partial or full refund depending on the materials provided to you.
II. These Terms may vary based on the commission. If you'd like to negotiate these terms, please contact me. Any changes to these terms will be made explicit to you before the commission is purchased.
III. You may not use any materials provided to you to in any manner that involves Artificial Intelligence, Neural Networks, or in Blockchain-related technology. This includes use in the training of Artificial Intelligence models; and use in cryptocurrency, non-fungible tokens, and any future developments in this space.2. Payment
I. You will be required to pay via invoice. This will be provided to you after the price of the commission is finalized.
II. Payment is due in full up-front, unless the total commission cost, before taxes and vendor fees, exceeds 300$ USD. If the cost exceeds this, you may discuss alternate payment plans. However, the final commission, including the high-quality, unwatermarked illustration, and any other materials, will not be delivered until payment is received in full.
III. You may be charged additional fees. These include, but are not limited to, a design fee for clients who do not have references for their characters, an expedition fee for short deadlines, revision fees for excessive modification of the artwork, and non-disclosure fees if you'd like to request a non-disclosure agreement.
IV. The exact price of the commission will be provided prior to payment. Please reach out to discuss the price if necessary.3. Client Obligations
I. You, the Client, must read the terms of service in full.
II. You, the Client, must maintain professional conduct during the commission process. Disrespectful behavior may result in the termination of your commission and/or the refusal to work with you in the future.
III. You, the Client, must provide all relevant details during the commission process. You assume responsibility for providing all relevant details and materials necessary to the final product.
IV. You, the Client, may request a refund only if the commission is incomplete. Not all refund requests will be accepted, and you may only receive a partial refund depending on the progress of the commission.
V. You must respond in a reasonably timely manner.4. Copyright and Usage
I. By commissioning me, you are purchasing my service as an artist only. I retain all rights to any commissioned works and materials provided to you.
II. I reserve the right to redistribute the work in any manner, unless otherwise explicitly stated by the client and agreed to by the artist prior to the initial payment for the commission.
III. I reserve the right to stream, record, or otherwise distribute videos, images, and other materials involved in the production of the commission, unless otherwise explicitly stated by the client and agreed to by the artist prior to the initial payment for the commission.
IV. You may not claim my work as your own, nor may you upload my work to galleries intended to showcase your own works.
V. You may use the artwork for personal use. This includes, but is not limited to: displaying on social media as a header or avatar; and physical reproduction of the artwork, including prints, for PERSONAL USE.
VI. You may not distribute the image without proper credit. You may not crop the image to exclude the signature unless you provide credit elsewhere.
VII. Please post the low-quality, watermarked version of the artwork online, unless you have explicit permission. You may not post the full artwork without the signature.
VIII. If you are provided a final product that has been modified by Glaze or Nightshade, you are required to post this online over the unmodified version. You are not permitted to resize this image.
IX. You may not change, edit, or modify any works or materials provided to you without permission. This includes tracing over any illustrations to create a separate artwork.
X. You may not use the commission for commercial purposes, unless you have acquired a commercial license.
XI. Any designs explicitly stated to be created for you will become your intellectual property. You are responsible for defending your rights by explicitly stating that you own said design.
XII. I do not retain the rights to your characters outside of the commissioned work, nor do I retain the right to claim any of your designs as my own. However, I do retain the right to distribute the artwork in any manner as my own intellectual property.5. Revisions
I. You, the Client, reserve the right to request revisions during the entirety of the commission process. However, more than one major revision during the sketch phase, and any revisions requested beyond the sketch phase may incur additional fees.
II. I, the Artist, retain the right to deny revisions for any reason. Excessive revisions may result in the termination of the commission.
III. The scale of any revisions are at the discretion of the artist.
IV. Any fees incurred as a result of a requested revision will be communicated before the revision is made. Revisions will only be made when agreed upon by the Artist and Client.
V. It is your responsibility to effectively communicate the details of a revision. If you fail to provide the details necessary to deliver a desired final product, I cannot be held responsible.
VI. You will be asked to provide feedback at nearly every stage of the commission process. If you fail to provide sufficient feedback, I cannot be held responsible.6. Process, Queue times, and Deadlines
I. It may take several days or weeks to respond to an initial inquiry. You are not obligated to move forward in the commission process if you change your mind.
II. You may set a deadline to your commission, however it may incur additional fees depending on the severity of the deadline. This will be communicated prior to payment.
III. I reserve the right to push back deadlines if I am unable to fulfill them. You will not be subject to deadline fees and will be refunded any deadline fees if this occurs.
IV. I reserve the right to take up to four weeks to start on your commission, and up to 12 weeks to finish your commission. If my queue is longer than four weeks, you will be notified of this at the time of purchasing your commission. Please do not send reminders of your commission prior to this four-week window unless you have a deadline.
V. You are responsible for enforcing the deadline of your commission. I may not be held responsible if the Client does not effectively communicate commission deadlines.
VI. You may request updates at any time, but no more than twice a week. I am not obligated to respond to update requests, especially if you are sending excessive reminders.
VII. Commissions may not be completed in chronological order. If your commission has not been completed 20 weeks from payment, you may request a full refund. Your commission will not be completed if you are refunded.
VIII. You will receive at least one sketch to provide feedback to during the initial stages of the commission. Failure to respond to this in a timely manner may result in the termination of the commission.7. Final Product
I. You will receive:
- A high-resolution PNG image upon completion of the commission.
- A low-resolution, watermarked image prior to final payment, or upon completion of the commission.
- A final sketch at the end of the drafting phase. This is your last opportunity to request revisions without potentially incurring fees.
- A flat color sketch (depending on commission type)
II. You may request:
- Additional file types (such as JPG over PNG)
- The CSP or PSD file used in production of the commission. This may be refused or cost an additional amount. A signature will be appended in the same spot on every layer to prevent removal.
III. If you are not satisfied, please let me know!
